1. About us

IBC Services is a trading service of Jewell Contractors Ltd, a company registered in England and Wales under company number 07800900.

These Terms and Conditions apply to the use of the IBC Services website and to quotations and services supplied by Jewell Contractors Ltd under the IBC Services brand.

References to “IBC Services”, “IBC”, “we”, “us” or “our” mean Jewell Contractors Ltd.

References to “you” or “customer” mean the person, business or organisation requesting or purchasing our services.

2. Our services

IBC Services provides specialist dry ice blasting and related cleaning services to commercial and residential customers.

Information provided on our website is intended to give a general description of our services. The suitability, scope, method and price of any work will depend on the circumstances of the individual job and will be confirmed separately.

Submitting an enquiry through the website does not create a contract or obligation for either party to proceed.

3. Quotations

Quotations are provided free of charge unless we agree otherwise with you before carrying out an assessment.

Unless stated otherwise on the quotation, quotations remain valid for 30 days from the date of issue.

A quotation will be based on the information reasonably available to us at the time. Where circumstances, site conditions, access requirements, contamination, surface conditions or other relevant factors differ materially from the information provided, we may discuss changes to the scope, price or timing of the work with you before proceeding with affected additional work.

4. Formation of a contract

A customer may contact IBC Services to discuss the work required.

We may assess the proposed work and provide a quotation setting out the agreed scope and price.

A contract for services is formed when the customer accepts our quotation and we confirm the booking or otherwise confirm that we have accepted the instruction to proceed.

Any significant changes to the agreed work should be agreed between IBC Services and the customer.

5. Deposits

A deposit may be required before work is scheduled or commenced.

The amount and payment requirements for the deposit will be discussed with the customer and confirmed as part of the quotation or booking process.

Where a customer cancels a booking, treatment of any deposit will depend on the circumstances of the cancellation, costs reasonably incurred by us and any statutory rights that apply.

Nothing in these Terms affects a consumer’s statutory rights.

6. Payment

Unless otherwise agreed in writing, payment of the outstanding balance is due upon invoice.

Any deposit paid will be credited against the total amount due.

Invoices should be paid using the payment method and details stated on the invoice.

Where payment is overdue, Jewell Contractors Ltd reserves the right to pursue amounts properly due in accordance with applicable law.

7. Customer responsibilities

Customers must provide information that is reasonably accurate and complete about the work required and any circumstances that may affect our ability to carry it out safely and effectively.

Where applicable, the customer is responsible for:

  • providing safe and reasonable access to the work area;
  • identifying the surfaces, materials, equipment or property to be treated where this information is known;
  • informing us of known hazards, hazardous substances, contamination or other relevant safety concerns;
  • obtaining any permissions reasonably required for us to access or work at the site;
  • providing access to utilities or facilities where these have been agreed as necessary for the work; and
  • ensuring the work area is reasonably available at the agreed time.

We may suspend or postpone work where we reasonably believe conditions are unsafe or materially different from those described to us.

8. Performance of the services

We will provide our services with reasonable care and skill.

Timescales given for completion are estimates unless we expressly agree that a particular deadline is binding.

We will take reasonable care when carrying out work, but customers acknowledge that cleaning results may vary depending on factors including the condition, age, material, coating, contamination and previous treatment of the surface.

Where we identify a material risk to a surface or item that was not reasonably apparent beforehand, we may stop the affected work and discuss the appropriate next steps with the customer.

9. Cancellations and rescheduling

Customers should contact us as soon as reasonably possible if they need to cancel or reschedule booked work.

For cancellations outside any statutory cancellation period, we may retain or charge an amount that reasonably reflects losses directly caused by the cancellation, such as costs already incurred or resources committed to the job, where permitted by law.

We will take reasonable steps to minimise avoidable losses.

Where we cancel or reschedule work, we will contact the customer as soon as reasonably practicable and arrange an alternative date where appropriate.

We are not responsible for delays caused by circumstances outside our reasonable control, but we will take reasonable steps to minimise disruption.

10. Consumer cancellation rights

Where you are a consumer and enter into a contract at a distance or away from our business premises, you may have a statutory right to cancel the contract within 14 days, subject to applicable law and exceptions.

Where you expressly ask us to begin providing services during a statutory cancellation period, different rules may apply, including circumstances in which you may be required to pay a proportionate amount for services already provided before cancellation.

Where the service has been fully performed following the required request and acknowledgements, statutory cancellation rights may cease where the law provides for this.

Nothing in these Terms limits any cancellation or other rights that you have under consumer law.

11. Changes to agreed work

If the customer asks us to carry out work outside the agreed quotation or scope, we may provide an additional quotation or otherwise agree the additional cost before carrying out that work.

We will not treat substantial additional work as included in the original quotation unless it was reasonably within the agreed scope.

12. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

For consumer customers, nothing in these Terms affects rights or remedies available under applicable consumer law.

We are not responsible for loss or damage caused by inaccurate or incomplete information supplied by the customer, undisclosed defects or hazards, or circumstances outside our reasonable control, except where responsibility cannot lawfully be excluded.

Business customers are responsible for ensuring that our services are suitable for their particular commercial requirements.

13. Website information

We take reasonable care to keep information on the IBC Services website accurate and current, but website content is provided for general information and may change.

Photographs, descriptions, examples and other content should not be treated as a guarantee that every job will achieve identical results.

A quotation or other written agreement relating to a particular job takes precedence over general information on the website where there is a conflict.

14. Intellectual property

Unless otherwise stated, the website and its content, including text, branding, graphics, photographs, video and design elements, are owned by or licensed to Jewell Contractors Ltd.

Content may not be copied, reproduced, distributed or commercially exploited without permission, except where permitted by law.

15. Acceptable use

You must not misuse the website, attempt to interfere with its operation, introduce malicious software, attempt unauthorised access, or use the website for unlawful purposes.

16. Third-party services and links

The website may use or link to services provided by third parties.

We are not responsible for the content or availability of third-party websites that we do not control.

Use of third-party services may also be subject to the provider’s own terms and policies.

17. Privacy

Personal information submitted through the website or otherwise provided to us is handled in accordance with our Privacy Policy and applicable data-protection law.

18. Complaints

Customers who have concerns about our services should contact us as soon as reasonably possible so that we have an opportunity to investigate and, where appropriate, resolve the matter.

Nothing in this section affects a consumer’s statutory rights or remedies.

19. Changes to these Terms

We may update these Terms from time to time.

The version applicable to a particular service contract will normally be the version in effect when that contract is entered into, unless a change is subsequently agreed or required by law.

The latest website version will display its most recent update date.

20. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you retain any rights you have under applicable law regarding where legal proceedings may be brought.

If you are a business, the courts of England and Wales will have jurisdiction over disputes arising from these Terms or the services supplied by us.
